Can I take action against my phone company if they don't keep to their word.

when i first took out my 3 phone contract, I was told I could upgrade my phone and tariff for free at any time aslong as it is to a more expensive tariff/ I recently lost my phone and instead of paying for a new one I thought I would just upgrade my tariff. But now they are telling me I am not able to do that I have to pay for a new one and they expect me to keep paying for my current contract aswel. If I break the contract I can have legal action against me so why is it not the same for them. This is just one of many lies they have said to me as they have cost me thousands of pounds in nearly 36 months. What can I do about it because I asked to speak to the manager but they insisted they could help but were all useless I just kept getting passed around to different people until I had enough and put the phone down.

There is a difference between upgrade and "give me a new phone". An upgrade requires you to surrender your old phone in exchange for a new one.

You lost your phone so suck it up and buy a new one.
