How serious is Possession of drugs under Sec. 4(1) CDSA?

My 23-year old son was smoking weed alone in his car parked in a Community Centre car-park at Markham, Ontario. Two cop cars came and asked him to get down. They frisked him and searched the car and found drugs worth Cdn. $30 in the car. They asked my son from where he procured the drugs which he refused to answer.

Then they served him an "APPEARANCE NOTICE ISSUED BY A PEACE OFFICER to a person not yet charged with an offence" alleging him to be in "Possession Sec. 4(1) CDSA". He has been asked to appear in Court after a month at 50 Eagle Street, Newmarket. He does not have any criminal record.Please let me know what how serious this is and what we are supposed to do under these circumstances?

I'm actually in almost the EXACT SAME situation, just that I'm 19, I was at the back of a street and I had a buddy with me.

How did you deal with the situation? Were any charges laid? Did you hire a lawyer? Was it necessary? Was anything recorded on your son's criminal record? How would you recommend I deal with this situation? My court date is in about a month.

well sir, im in the same situation as y'all, but im only 17. i was suposed to go to court after 2 months but the arresting officer never sent my paperwork to the courthouse/

i got the same shit i had less than a gram and i have a court date set for a month from today. do i need to hire a lawyer? and am i going to have a criminal record because of this?

It will not be bad, in alot of cases you just pay $50 to a charety. Iv been caught with acid and they let me of the charge in court but now they caught me selling, sucks cause lots of the people i sold to were very nice people and i will miss getting to see them as much plus they will need to find a new way to get there harmless weed!
