My husband, me and my roommate moved in an apartment Aug 2005 to a 2 bedroom and signed a lease for one year. The lease was under my husband and roommate's name. Up to now we are still leaving at the same place on a month to month basis (they sent us letter to renew but we didn't sign). Me and my husband decided to move out in 2 months but my roommate doesn't like to sign to release my husband's name from the lease. Because if she does, the landlord is charging her $30 extra for hydro. She wants us to move out but leave our name on the lease. My husband don't want to do that. The landlord said they cannot remove my husbands name from the lease unless my roommate sign the release form. She now have a husband and a kid that is leaving with us on the apartment since she got married Mar 07 & have the baby last month. Please help on what to do. Can we moved out still? Are we going to be stuck on the lease and wait for her to sign? The reason being is all baby's stuff are in the living room
