do i have any legal rights without a valid contract?

there is an offer to sell tv for £400 but i sent by post £375 as a counteroffer expecting him to accept.... he chooses not to accept but keeps my money. Since there is no contract because he did not accept my counter offer, he can not be in breach of contract.. do i have and legal right to my £375 back?
