We purchased a new fifth-wheel trailer in 2007. Last winter, we sent it to the manufacturer in Indiana for warranty repairs. On the way back to our home, the driver had an accident and our rig was damaged. We did not contact our insurance as we were not in possession of the rig at the time of the accident. It went back to Indiana to repair the accident damage. The manufacturer sent it back to us, told us to use it and report any problems. We did not want to accept a damaged rig but they assured us they would repair any defects. There are multiple problems now including leaks, cracked cupboards, scratched dinette and more. We have been calling the manufacturer since July trying to resolve the issue. The manufacturer has offered to repair the rig but no amount of repair will ever fix the damage. What are our legal rights regarding our new and now damaged property?
