I have just joined a salon/spa as an independent contractor (4 weeks ago). I am an esthetician, masseuse, certified laser therapist and reflexologist - I supply all my equipment and products and do all my advertising. I do get referrals from the salon too. As a health practitioner, I am required by law to have people list their health status and as I treat them, I record their progress. I supply these health papers too. When people first come to the salon, they give their information to the receptionist and it is recorded on the salon's computer, so the information stays there. The owner of the place is afraid that if I build up clientele and leave him, I will take the clients with me so he decided to draw an agreement and have me sign it. This agreement says that I have to give him the medical forms I am filling for every client for him to keep (for privacy of the clients) at the end of each shift, although I have access to it any time I want to but he keeps them. it doesn't sit well with me because when you go to your hairdresser you don't give them your health history but I am a health care provider therefore I have to know their health problems in order to treat them properly. If they have a problem with me and they sue me, I'll have to have proof that I did my job the right way according to their health information but if he keeps those and someone sues me, I won't be able to trust him to give me the information, so I could loose everything I own if that happens. Also, all of the people who work there are independent contractor, not employees, when I asked him if he required this signed agreement from every one there he said why do you care what I do with other people, this is between you and I. well, if it's only me, that's discrimination right>
