Trumped Up coercetion for cooperation by RCMP
May I swear at a police officer, while being questioned, and be guilty of disturbing the peace?
May I be arrested if the conversation is lacking loudness?
I was standing beside my vehicle after returning a guest to their place of residence.. While closing some sort of net & I was caught up in the situation. Disliking the questions and interrogation tactics. I Invited the officer to F**K Off. As I was a quest on a private driveway by invitation and sealed there by two cruisers, while the suspects where taken into custody on the public road. I was arrested for .. disturbing the peace .. while solely responding to a single officer. While in custody and in detention in the back of the police cruiser .. I refused to submit to a Breathalyser Screening. I had had a drink (one ounce an hour earlier ... smelt of booze due to a spill accident ... which facilitate returning my guest home) I was not driving when taken into custody .... simply standing beside my vehicle awaiting the conclusion of the drama unfolding on the public road. Still was charged like I was driving impaired and stopped by police., my driver's license confiscated... for 90 days. Not to mention the mark on my license and consequential higher cost in insurance.
I maintain their arrest(on private property while I was simply an innocent by-stander caught up witnessing the arrest of suspects) ... and retention of my DL was unlawful and was simply used a coercetion tactic, meant intimidate & punish me for ... disturbing the peace ...
I lose my DL; have to hire a lawyer; be without the DL until my (potential) court date arrives (45 day hence)
Comments and advice as to how I might deal with this .. in my opinion ... illegal invasion of my rights, wrongful arrest, and sequentially, the loss of my money (legal defense and need for new ID)and my Driver's Permit.
Like the Tarazed tactics on the news so much these days (what amounts murder at the one end or brutality at the other end) ... no need to beat the suspect ... just punish him .. suspend his rights as a free citizen ... with the freedom to express himself and move about conveniently.
When is enough, enough before one must make a stand of principle, no matter the sequential cost and lost of rights? Where do you draw the line....who decides?
For myself, I have witnessed past, what I felt were transgressions, by authority.
However, because I was not directly involved … why make a big deal of it, right? .... just make a mental note to ponder “.... what if... I had been the target of injustice”?
I do not have an agenda to pursue here ... Just indignant that peace officers cooperate to manipulate and intimidate by using laws that ... while serving a purpose ... may be misused by them sworn to uphold the principle of the law.. An abuse of authority, responsibility and privilege.
