ex wants to take son out of province????? can she??????????

hello.

my husband and his ex have a 4 yr old boy, who they curently have a custody agreement with that she the mother has primary care and the father has 3 weekends a month alternating holidays extra xmas time and summer time visits, they live about 1.5 hrs apart, and we often take our son long weekends or when it is convient it her. the agreement is joint custody ,

the question is ... she now wants to move from NS to Alberta with our boy,

she says she has a great job opp out there, she has a father (his grandfather) and a son who both live out there (she does not have primary over her oldest son)

we have his sister here. who is 7m and he is 4 his brother out west is 12 yrs old.

also here are his aunt and cousin(2yrs old) his 4 grand parnets and 2 great grand parnets,

our son is suppost to start school here in NS in the fall.

they have a hearing in 2 week times to see if they have came to an agreement.

but we do not what him to go, it is NOT in his best interst to move away from everything he is use to, to have her working 40+ hrs a week and to be at a baby sitters and school. his sister is here, and father and step mother.

so question is,,, can she take him? is there anything we can do to keep him here? any pts we should bring up?
